Recent Developments
Ahead of tomorrow’s meeting, and particularly for anyone who cannot make tomorrow’s meeting, we are also providing a short update on recent developments.
As reported in our update of 4 September 2025, on 3 September the AFAP (with support from AIPA and the TWU) took the unusual step for a union of applying to terminate the Express Freighters Australia (Operations) Pty Ltd Enterprise Agreement 2021 (“current Agreement” or “existing Agreement”).
Since lodging the application, EFA has notified the Fair Work Commission (FWC) that it opposes the application to terminate the current Agreement, and it is now set for a hearing before a Full Bench of the FWC on a date yet to be determined.
The FWC has however issued Directions in this matter (Matter No. AG2025/2996) for the provision of various material by certain dates –

In accordance with the Directions, this week the AFAP filed submissions (
click here), a Witness Statement from AFAP Executive Director, Simon Lutton (
click here) and a couple of authorities.
In accordance with the Directions, AIPA is intending to provide a submission in support of the application by Tuesday 14 October 2025.
EFA also has until Tuesday 14 October 2025 to file and serve its material opposing the termination of the current Agreement.
All the material will then be made available to EFA pilots by 21 October 2025 and all EFA pilots given the opportunity to provide their views directly to the FWC via email to
chambers.cross.dp@fwc.gov.au before 28 October 2025.
In addition, and somewhat separate to the above process, a conciliation conference before a different member of the FWC involving all parties (AFAP, AIPA, TWU and EFA representatives) has been scheduled for 2:00pm on Thursday 23 October, in Sydney in person. We remain hopeful that this conference will provide an opportunity for EFA to outline a replacement Agreement proposal capable of being supported by a majority of EFA pilots.
If EFA does provide a replacement Agreement proposal capable of endorsement, we would be in a position to discontinue the application to terminate the current Agreement and cease the current PIA.
If EFA does not provide a replacement Agreement proposal capable of endorsement, we will need to continue with the application to terminate the current Agreement and consider steps to escalate PIA.
