Re Application of Award & NES Conditions

The AFAP have again contacted the Chartair CEO relating to a proposed way forward to ensure pilots receive the minimum conditions of the Air Pilots Award 2020 and National Employment Standards (NES), these are your safety net minimum conditions.

Over an extended period Chartair has not offered any way forward (and although provided leeway have not responded) to address key matters raised, this includes matters relating to,

  • RDO/DIL Payment Rates
  • Hours of Work and Overtime Hours
  • Addition to Salary (Piston engine aircraft)
  • Rostering arrangements in accordance with the Award

The AFAP also informed Chartair regarding a recent decision in the courts regarding this Award, that supported the following key points,

  • Hours of work for a pilot are 38 hours per week, unless there is an average hour’s arrangement agreed between the employer and the pilot,
  • The standby/reserve hours form part of the ordinary work hours of the Award (i.e. part of the 38 hour week above), and
  • The hours worked above 38 hours per week (or average hours arrangement), or overtime hours are viewed to be paid on pro-rata basis (that is at usual hourly rate of the Award as there are no penalty rates).

The AFAP are discussing with current and previous members of the pilot group approaches to potential underpayment of wages claims.

Pending a response from the company requested by COB 10 November the AFAP will provide a further update to members.
