AFAP Skippers Pilots Update 2024 #1

The AFAP note that the Skippers Aviation Pilots Enterprise Agreement 2016 (the Agreement) nominal expiry date is approaching a 5 year anniversary on 30 June 2024.

Changes to the Fair Work Act 2009 (Cth) allow for a bargaining representative (the AFAP) to request they commence bargaining with an employer within 5 years of the Nominal Expiry Date (NED) and they will be required to comply and commence bargaining – so it is a timely opportunity in early 2024 to explore these matters further with members. Alternatively, if members wait until after July 2024 either the employer own initiative or via a majority of employees (majority support determination process) is required to commence bargaining.

The AFAP are seeking general feedback from members whether you seek your bargaining representative, the AFAP to request the employer to commence enterprise bargaining.

As a first step, we ask members to email AFAP Industrial Officer Jason Newell, on Jason@afap.org.au to express interest to bargain for a new enterprise agreement (the AFAP is not required to disclose which members seek to bargain).

Should AFAP members, pilots employed by Skippers Aviation be seeking the AFAP to request commencing bargaining we would engage and update you further regarding communication to the employer, the bargaining process, AFAP delegate(s), and further surveys and discussions on what is important in a new agreement.
