FWC Decision & Upcoming Council Elections

A couple of topics to report on, firstly the Fair Work Commission has provided their decision in relation to the starting point for the upcoming arbitration. You may recall the hearing for this matter was in early May and the decision was handed down on Friday afternoon. For those interested the full decision can be found in this link.

Briefly, the FWC decided that the agreed position between the parties, was as set out in the 22 December Proposed Agreement, with the exception of those 11 terms that were not agreed. Members may remember that during the height of the action there was reference to 12 outstanding items (one of which was effectively a duplication - making 11 areas where there was no agreement). These unagreed areas will therefore be the items to be arbitrated on by the FWC. The full list of these 'unagreed items' is right at the end of the decision attached.

The AFAP legal team will now be preparing for the next stage which is the full arbitration on these matters. As yet we can't provide any potential timeframes as to how long this will take.

Council Elections

As we mentioned recently, the AEC will today be sending out material for AFAP Council Elections. Network will have a Council of 8 reps and paperwork will be sent to financial members via email, from the AEC directly. In light of what's being going on in Network and with the CEO still not responding (or even acknowledging) the AFAP correspondence seeking appropriate support for the new Council, it is essential that we get as many nominations as possible. Please note nominations must be with the AEC no later than 12:00 noon Australian Eastern Standard Time (AEST) on 05/08/2024.

The new Council will effectively set the direction of how relations with the company progress, the first step being for the company to recognise the fact that the Council represents 90% of the Network workforce.
