AFAP Members Update - CAE Award Application & Dispute

The AFAP has written to the CAE General Manager regarding matters in dispute and that we are seeking for a timely resolution, outlining steps to be undertaken.

After the AFAP agreed to CAE to allow some additional time to respond to questions about Award conditions, no response has been provided since 18 July 2024 AFAP correspondence. This correspondence set out queries relating to application of conditions to human resources contact in CAE, and now escalating to the general manager.

The AFAP were informed by Employsure representative that matters may be responded by late August. The AFAP view unnecessary delays to apply mandatory Award conditions is unnecessary, and not responding to simple queries in good faith can not lead to a resolution. Therefore the AFAP established a separation of matters, to add some structure towards resolution in accordance with the Award procedures.

The AFAP has prioritised the matters of the Award entitlements to Accident Insurance and Loss of Licence Allowance, workplace rights that support pilots (and their families) wellbeing and welfare.

See attached AFAP correspondence regarding the disputed matters.

In the case the identified priority items are not resolved in a timely manner the AFAP views assistance with dispute resolution and assistance of the Fair Work Commission as part of dispute resolution procedure.

  • In addition to the attached dispute matters, the AFAP will continue to follow up with CAE on all the other matters raised by the AFAP 18 July 20240 correspondence including addressing issues of;
    • Employer requests for employee payments (training cost matters),
    • The purported individual flexibility agreements from employment contracts,
    • Clarification if CAE has procedures to ensure pilots have not been paid less than the Award, and
    • Improving consultation and rostering as per the Award.

The AFAP has offered to provide CAE a summary of rostering and consultation concerns (including AFAP correspondence, and de-identified summaries from pilot feedback). This detail will be provided to Employsure representative in due course.

What Happens Next?
Pending the CAE response to the Accident Insurance and Loss of Licence Allowance matters this week, the AFAP will continue to report back to members on all matters.
