Arbitration Update - Additional Material Submitted

You will recall that we recently advised AFAP members that the additional submissions sought by the FWC in relation to this ongoing arbitration were sought by 5th May. The submissions were to address the recent Full Bench Federal Decision to uphold an AFAP supported case, that standby or reserve must count as duty and how this impacted the BOOT assessment in this arbitration.

Disappointingly NAA sought and were granted another one day extension (despite our opposition) and consequently all the submissions were lodged with the FWC at close of play yesterday.

The submission of a fair bit of additional material to the FWC will in all likelihood require some time for this to be reviewed and considered by the full bench. Consequently it will probably be some time yet before an arbitrated decision is handed down. That said, we are hopeful that the BOOT assessment required to be undertaken by the FWC, will be last hurdle to be completed before their decision is made. As to how long this will now take I'm afraid we cannot even hazard a guess.

This process is clearly nearing its conclusion and we again thank all members for remaining patient through what has been a long and arduous process. We shall of course advise you of any developments.
