Arbitration Update
Further to our last brief members may have become aware of developments, with the FWC now wishing to hold a one day hearing into the BOOT evidence submitted by the parties.
The FWC has confirmed this morning despite requests from all parties to hold an early hearing, the decision has been made to hold a one day hearing on 23rd June in Perth.
While this development is of course frustrating to members the AFAP are confident that this closer examination of BOOT related evidence can only assist our argument that the current determination proposed by Network has significant shortcomings that are only exacerbated when you factor in the necessity of Network to now account for reserve as contributing to duty.
For Qantas to argue that the inclusion of reserve as duty has no impact or relevance on their proposed determination is clearly an argument that needs to be tested. Indeed much of Qantas's industrial strategy of having their subsidiary organisations paying their pilots close to the Award rate will be completely undermined by this ruling and is probably a reason they are heavily supporting the current attempt to appeal the recent full bench decision, despite the clarity and unanimity of the ruling.
As always your Council along with our our lawyers will continue to advocate for the Determination proposed by the AFAP, which clearly built in the need to address reserve as a duty and offered built in protections to ensure that a pilot in Network would never be faced with what occurred with the last EA.
